Conditions of participation in the Snorefox M medical device test of Diametos GmbH
These conditions of participation apply to the Snorefox M medical device test of Diametos GmbH, Opolestraße 2, 14469 Potsdam (hereinafter referred to as the "Organizer"). Participation in the medical device test is governed exclusively by these conditions of participation.
1) Duration of the medical device test
The Snorefox M medical device test is active from 23.02.2024, 08:00 CET to 15.03.2024, 10:00 CET. During this period, Snorefox users will have the opportunity to register for the medical device test.
2) Procedure of the medical device test
Participation in the medical device test is aimed at users of the Snorefox app who are interested in testing the Snorefox M medical device free of charge. The medical device testers will be selected at random from all registrations. As part of the medical device test, the selected testers will be provided with a free upgrade code for the Snorefox M medical device. The selected testers will then be asked to complete a questionnaire online.
Participation is only possible within the participation period. Only one registration per participant can receive a free upgrade code. It is strictly forbidden to use multiple accounts. Participation in the medical device test is free of charge.
3) Eligible Participants
Natural persons who are resident in Germany and have reached the age of 18 are eligible to participate. If a participating person has limited legal capacity, the consent of their legal representative is required.
The organizer reserves the right to exclude persons from participation at its own discretion if there are justified reasons, for example:
(a) in the event of manipulation in connection with access to or performance of the medical device test, (b) in the event of breaches of these conditions of participation, (c) in the event of unfair trading or (d) in the event of false or misleading information in connection with participation in the medical device test.
4) Transmission of the free upgrade code
Participants randomly selected as medical device testers will receive a free upgrade code for the Snorefox M medical device to be redeemed within the app. Only one free upgrade code will be issued per participant. It is strictly forbidden to use multiple accounts.
The upgrade code will be delivered promptly by e-mail at the organizer's expense exclusively to the participant of the medical device test or to the participant's legal representative. The upgrade code cannot be exchanged, collected by the participant or paid out in cash.
5) Premature termination of the medical device test
The organizer reserves the right to cancel or terminate the medical device test at any time without prior notice and without giving reasons. The Organizer will make use of this option in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, proper performance of the medical device test cannot be guaranteed. If such a termination is caused by the conduct of a participant, the organizer may demand compensation from this person for the damage incurred.
6) Privacy
Personal data must be provided in order to participate in the medical device test. The participant assures that the personal details provided, in particular first name, surname and e-mail address, are true and correct.
The organizer points out that none of the participant's personal data will be passed on to third parties, nor will they be allowed to use them.

7) Revocation
Participants are free at any time to have their registration data deleted by sending a revocation to community@diametos.com and thus withdraw from participation.
8) Liability
Claims due to possible material and/or legal defects in the vouchers donated by the prize sponsors are to be asserted exclusively against them.

The organizer's medical device test is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.
10) Severability Clause
Should a provision of these Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the rest of these Conditions of Participation.
